ABOUT MIGRATION AGENTS

A registered migration agent is someone registered with the Office of the Migration Agents Registration Authority (Office of the MARA) who can provide advice on visa requirements, help lodge a visa application and deal with the department on your behalf.

You are responsible for the accuracy of information and supporting documentation provided as part of your application, even if you use a registered migration agent.
 
You want to hire a Migration Agent to assess your situation and establish if you are eligible to obtain an Australian Visa.

Nowadays, you can do most things yourself, but you want to appoint a professional when the stakes are high.

Accredited in a Community Language
To obtain the community language points, you must be accredited by the National Accreditation Authority for Translators and Interpreters (NAATI) at the para-professional level (Level 2) or higher.

Partner skills
You can claim partner skills if your partner:
is under 50 years of age;
has competent English;
has an occupation that is on the same skilled occupations list as your nominated occupation;
has been assessed by the relevant assessing authority as having suitable skills for their nominated occupation;
is coming to Australia with you;
is not an Australian citizen or permanent resident.

Professional Year Program
Your Professional Year must have been:
completed in Australia in the four years before you are invited to apply for a visa;
in your nominated occupation or a closely related occupation;
completed over a period of at least 12 months;
provided by one of these organisations:
- the Australian Computer Society
- CPA Australia
- Chartered Accountants of Australia and New Zealand
- the Institute of Public Accountants (formerly the National Institute of Accountants)
- Engineers Australia.

Study in regional Australia or a low population-growth metropolitan area for 2 years

Proof that you met the Australian study requirement while living in regional Australia or a low population-growth metropolitan area for two years:
- residential lease agreements
- utilities bills and bank statements showing your name and residential address.
- academic transcripts or other documents that show the campus at which you completed your study was located in regional Australia or a low population growth metropolitan area.

ENGLISH LANGUAGE ABILITY

It is a well–known fact that applicants are required to demonstrate their English language skills for many Australian visas.

There are several levels and English test types accepted by the Department of Immigration and Border Protection (DIBP) depending on the visa you apply for.

You can prove that your English language ability is at the appropriate level by:

- showing that you have studied in English for at least five years in one or more of the following countries: Australia, United Kingdom, Canada, New Zealand, the United States, South Africa, or the Republic of Ireland;
- being enrolled by your education provider;
- passing an approved test of your English language ability.
 
If you are a citizen of, and hold a valid passport from, Canada, New Zealand, the Republic of Ireland, the United Kingdom, or the United States, we consider that you have Competent English.

However, if you want to claim points for Proficient or Superior English, you need to achieve the required score from one of the English language test providers.

If you are applying for Skilled Migration, you will need to prove your English language ability.
The required level of English depends on the visa subclass you are applying for.

The IELTS test is the most common way of evidencing English language ability.
Either the Academic or General Training versions of the test are acceptable to the Department of Immigration, but some skills assessing authorities require applicants to sit the Academic version. You will need to obtain a minimum score in each band of the IELTS (Reading, Writing, Listening, Speaking) in a single sitting.

The Occupational English Test (OET) is also accepted as evidence of proficient and superior levels of English. The OET is only appropriate for medical and allied health professionals.

The Pearson Academic Test of English (Pearson PTE) and TOEFL Internet Based Test (TOEFL iBT) are now accepted for all skilled subclasses. Most state and territory governments also recognise these tests, as do some skills assessment authorities.

The Cambridge Test of English is also accepted from January 2015.
